Mayors v. FCC 5G Arguments Heard in 9th Circuit Court of Appeals
The FCC and a coalition of local officials gave their oral arguments before the 9th Circuit Court of Appeals on Monday, February 9th regarding the commission's efforts in September of 2018 to streamline the deployment of 5G small cell infrastructure. The FCC limited the fees cities can charge wireless carriers to install small cell equipment in public rights-of-way and set prohibitive deadlines for thorough application review. The FCC's Republican majority argues that this preemption is necessary for cheap, timely 5G rollout, but cities and labor unions protest that the regulations trample on their rights.
